AGREEMENT
re: Article Publication in the American Historical Review

SAMPLE COPYRIGHT FORM FOR ARTICLES

Dear Full_Name:

The American Historical Review (the "Journal"), a scholarly journal published by the American Historical Association (the "AHA"), is pleased to accept your article entitled "Article title here" (the "Article") for publication in Volume XXX, no. XX, currently scheduled to be produced in (publication month) and distributed in (distrubution date). You agree to work with the Journal in good faith to resolve any differences regarding changes to the Article proposed by the Journal or you. The Journal generally resolves all issues of citation style and spelling in accordance with the Chicago Manual of Style and the Merriam-Webster Unabridged Dictionary, in addition to its own house style. The Journal will provide 100 reprints of your Article free of charge. You may order additional reprints for a charge. A reprint order is included in the package.

You represent and warrant that the Article is original, not previously published, that you have the legal right to offer it for publication in the Journal, and that no portion of the Article has been previously assigned or encumbered. You further represent and warrant that the Article contains no material that is defamatory, libelous, or obscene; or infringes the copyright or other legal right of others; or that would otherwise subject the Journal to liability. Should the Article contain material that requires written permission for inclusion, such permission shall be obtained at your expense, in a form suitable to the AHA, and submitted with the Article. You shall defend, indemnify, and hold the Journal, the AHA, and any third party licensees harmless against any loss, liability, damage, cost, or expense (including attorney's fees) arising in connection with any suit, proceeding, claim, or demand or the settlement thereof based on a breach of any of the above representations or warranties. These warranties and representations shall survive the termination of this Agreement.

You hereby transfer and assign to the AHA all right, title, interest, including all copyright, in and to the Article in the United States and throughout the world. In return, the AHA hereby grants you, once the Article has appeared in the Journal, a nonexclusive, royalty free license to: (a) reproduce, distribute, perform, and display (and authorize others to do the same) the Article alone or as part of a book, anthology, or other collection (with the exception of another academic or scholarly journal), in print or electronic media; (b) to make or authorize others to make photocopies or other similar reproductions of the Article for personal, classroom, or nonprofit educational use; and (c) to distribute your own reprints. Each Journal issue is registered in the AHA's name with the U.S. Copyright Office.

The Journal permits educational institutions to reproduce and distribute articles free of charge for nonprofit teaching and research purposes. For profit publishers must pay a fee (currently $200 per use), which will be split with you. All reproductions permitted by the Journal must reproduce the Article in full, along with all footnotes and other supporting materials, except with your written permission.

This Agreement shall be governed and construed in accordance with the laws of the District of Columbia, without regard to its conflict of laws, principles, or rules. This Agreement constitutes the entire understanding of the parties and may only be modified or terminated in writing. If any part of this Agreement is declared invalid or unenforceable, the remaining provisions shall continue in effect.
